Taxotere Lawsuit Alleging Hair Loss and Vision Loss (2023)

This is the last update of theTaxotere Class Action(MDL) lawsuits as of February 2023.

Where do we stand now with the Taxotere hair loss lawsuits? There were two related studies. One before the pandemic in 2019 and another over the past year. Both ended in defeat for the plaintiffs.

The Taxotere lawsuits are not looking good at the moment. Do some mass damages lawsuits start with losses and the tide turns and plaintiffs start winning and the defendant offers fair settlements? Yes, 100%. But let's not pretend that there are many upsides to losing two processes in a row.

Some good news from Taxotere - Appeal won

The first texture lawsuit in court ended in a heavy loss for the plaintiff. But in an important development, the Court of Appeals for the Fifth Circuitreignsthe plaintiff should get a new trial because Sanofi made inadmissible expert statements in the main hearing. This is a great victory that breathes new life into Taxotere's demands.

What is Taxotere?

Taxotere is a chemotherapy drug used to treat various types of cancer, particularly breast cancer. Taxotere is a taxane. Taxanes are diterpenes produced by plants of the Taxus genus that have a taxadiene nucleus.

Taxanes are widely used as chemotherapeutic agents. Taxotere has been one of the most commonly used chemotherapy drugs since its development in the mid-1990s. Chemotherapy drugs like Taxotere work by attacking cancer cells in the body. Taxotere was originally developed and introduced by the New Jersey pharmaceutical company Adventis, now called Sanofi-Adventis.

What cancer does Taxotere treat?

After its FDA approval in 1996, a strong marketing push soon made Taxotere the chemotherapy drug of choice for the treatment of breast cancer. Breast cancer is one of the most common types of cancer with 300,000 women diagnosed annually.

In 2009, the majority of breast cancer patients had been treated with Taxotere at some point, making it the most commonly prescribed chemotherapy drug in the United States.

What does the Taxotere lawsuit allege?

The plaintiffs allege that the drug caused permanent alopecia, which is permanent hair loss. Plaintiffs allege negligent misrepresentation, fraudulent misrepresentation and more. But the bigger claim is the lack of a warning. The crux of this argument is that there was a duty to warn victims of the risk of permanent hair loss in order to give them a chance to consider other alternatives.

Taxotere has endured a notable fall from grace since its glory days in the early 2000s, and as it turns out, Taxotere has a very unfortunate flaw. In a certain percentage of women (between 10-20% depending on which study you read), Taxotere causes permanent hair loss. In general, everyone expects their hair to fall out during chemotherapy. It's the price you pay to get rid of cancer.

But hair loss from chemotherapy is said to be a temporary side effect. When people undergo chemotherapy, they reasonably expect their hair to grow back when the chemotherapy ends. Hair loss is a big problem, especially for women. Unfortunately, thousands of women treated with Taxotere for breast cancer later learned that their hair would never grow back.

We now know that Taxotere causes permanent hair loss in a specific subset of patients. We also know that Sanofi-Adventis has been very aware of this enduring side effect for years. There are many indications that Sanofi-Adventis was already aware of the problem of permanent hair loss in 1998. The company is said to have actively concealed this fact because it recognized that there was a risk that permanent hair loss would affect the marketability of Taxotere, particularly in female breast cancer. Patients For more than 10 years, Sanfoi-Adventis has not knowingly indicated that Taxotere can cause permanent alopecia in certain patients.

It wasn't until 2015 that the warnings on the prescription label were changed. To make matters worse, Sanofi-Adventis may have made false claims about Taxotere's effectiveness over alternative chemotherapy drugs.

One of the main reasons Taxotere became so widely available is because Sanofi-Adventis told doctors it was more effective at fighting cancer than less toxic chemotherapy drugs like Taxol. Taxotere not only causes permanent hair loss, it isnot lessmore effective than alternative chemotherapy drugs such as Taxol.

Watery eyes are caused by an overproduction of tears, which can cause tears to flow down the face. This can cause a variety of symptoms, including blurred vision, irritation, and redness around the eyes. The condition can be quite uncomfortable and can affect a person's ability to go about their daily activities.

The exact cause of watery eyes from docetaxel is not fully understood. However, it is believed that Taxotere can cause irritation or inflammation of the tear ducts, leading to increased tear production. In some cases, watery eyes can be a sign of more serious side effects, such as: B. an infection or inflammation of the eye.

Taxotere demands

After the shocking Taxotere crash, thousands of women are now dealing with permanent hair lossProduct Liability Claimsagainst Sanofi Adventis. These former breast cancer patients claim that Sanofi-Adventis lied about Taxotere's effectiveness and deliberately withheld the fact that the drug can cause permanent hair loss.

The evidence supporting these claims is very strong. There is no real argument about the connection between Taxotere and permanent hair loss. At least 10% of people treated with Taxotere experience permanent hair loss. It is also quite evident that Sanofi-Adventis was aware of this side effect and has been consciously concealing it for over 10 years. In some isolated cases, causality can be an issue.

However, the main battlefield in the Taxotere lawsuits will likely be the issue of damages. In most pharmaceutical lawsuits, plaintiffs suffer serious physical injuries such as heart attacks or strokes. In contrast, the Taxotere plaintiffs lost only their hair.

At first glance, hair loss may seem trivial compared to a stroke or organ loss. But permanent hair loss can be mentally and emotionally devastating, especially for a woman recovering from breast cancer.

Taxotere MDL

MDL is an acronym forMulti-Distrito Litigation. MDL is a special procedure in the federal court system that is often used in large-scale drug and product liability cases. In an MDL, hundreds or thousands of related cases in federal courts across the country are consolidated into a single court and assigned to one judge.

Cases remain consolidated in the MDL for efficient pre-trial discovery management. If there is no overall settlement at the end of the pre-trial/discovery phase, a few individual cases will be selected and sent back to their original courts for trial. The outcome of the trials in these first "flagship" cases will then be used as a benchmark for negotiating the settlement of the remaining cases. When a drugmaker like Sanofi-Adventis is suddenly hit by a wave of related lawsuits nationwide, they are almost always consolidated into one MDL.

In October 2016, an MDL for Taxotere hair loss lawsuits was established (MDL – 2740 Taxotere (Docetaxel) Product Liability Disputes). All Taxotere cases in the federal courts are now consolidated into this MDL and assigned to Judge Jane Triche Milazzo in the Eastern District of Louisiana. The size of the Taxotere MDL continues to grow very rapidly. When the CDM was founded in 2016, there were around 5,500 cases.

The plaintiffs' lawyers lost the first Taxotere case in 2019. The second trial, which begins in a few days, on August 23, 2021, is said to go better. (Defendant's attempt to dismiss this case before trialwas declinedby the MDL Judge.) If you have a claim and this lawsuit is successful, you have a reasonable expectation that it will benefit any future settlements in the Taxotere lawsuits.

What is the settlement value of the Taxotere lawsuits?

After two losses, it is difficult to speculate on liquidation amounts. A jury payout at the upcoming trial will renew discussions of expected individual settlement amounts in the Taxotere class action. But now is not the time.
